Scheduling Order
ORDER setting the following schedule for further proceedings in this matter: (1) the deadline to join parties shall be December 1, 2026, and any amendments to the pleadings shall occur within 30 days of any joinder or the joinder deadline, whichever is later; (2) the parties shall exchange initial disclosures, as required under Rule 26(a)(1), on or before December 1, 2026; (3) Plaintiff SMS DC CS01B, LLC, d/b/a Scale Microgrids shall serve any proponent expert disclosures, consistent with Rule 26(a)(2), on or before February 15, 2027; (4) Defendant/Third-Party Plaintiff Blue Ocean New Energy LLC shall serve any proponent expert disclosures, consistent with Rule 26(a)(2), on or before March 15, 2027; (5) Third-Party Defendants Solar Mounts, LLC, Solar Construction, LLC, Sol Engineering Solutions, LLC, DOTec Professional Corporation, and Dr. Ildefonso Gonzalez shall serve any proponent expert disclosures, consistent with Rule 26(a)(2), on or before April 15, 2027; (6) the parties shall submit final written discovery by April 15, 2027; (7) the parties shall submit a Joint Status Report regarding the status of discovery on or before April 23, 2027; (8) the parties shall serve any rebuttal expert disclosures, consistent with Rule 26(a)(2), on or before May 1, 2027; (9) discovery shall conclude on May 17, 2027; and (10) a Post-Discovery Status Conference is set for May 31, 2027, at 10:00 a.m. via videoconference.
