Pretrial Order
PRETRIAL ORDER: 1. NLT 21 days before the PTC, counsel shall file: a. list of witnesses & exhibits in accordance with the Fed.R.Civ.P. 26(a)(3): i. witness lists who will testify at trial; ii. witness lists iii. witness list to contain description of each exhibit in sufficient detail; b. motions in limine; c. transcript of all evidentiary depositions to be used at trial; d. pretrial memo brief containing a succinct statement of facts of the case, the issues of fact & issues of law; 2. NLT 14 days before the PTC, parties shall file: a. written objections; b. responses to any other party's motion in limine; and c. responses to any other party's motion for a ruling on any objection made in an evidentiary deposition. 3. At PTC, counsel for parties be prepared to: a. discuss & make possible stipulations of admissibility, or threshold foundation requirements for admissibility; b. disclose any demonstrative or summary exhibits intended for use at trial; c. possibility of settlement; and e. advise the Court of anticipated technological issues that may arise at trial. 4. Scheduling Order Deadline
SCHEDULING ORDER: 1. Deadlines: a. Rule 26(a)(1) by 9/3/2026; need not be filed in Court record; b. Motion to join additional parties or to amend pleadings 11/30/2026; c. Supplementation of disclosures & responses required by Rule 26(e) by 4/1/2027, need not been filed in Court record; d. Rule 26(a)(2) reports from expert trial witnesses, Pltf by 1/4/2027; Dft by 3/4/2027; e. Discovery by 6/1/2027; f. Dispositive & Daubert motions NLT 6/1/2027; 2. No motions to compel, or motions relating to discovery dispute, shall be filed unless all counsel involved in such dispute have first conferred. 3. The parties shall observe the following directives regarding the filing of discovery materials in this case unless the court otherwise so orders: a. Rule 26(a)(I) Initial Disclosures, Interrogatories & Answers or other responses thereto. b. Discovery depositions cited in any motion, or which may be used at trial for impeachment or other purposes, other discovery materials necessary to the decision of any motion filed herein shall be filed of record in this case. 4. No extensions of the deadlines set in this order. 5. TELEPHONIC PRETRIAL CONFERENCE set for 12/16/2027 at 02:00 PM in LEXINGTON before Judge Karen K. Caldwell. Order w/call info will be entered prior to the PTC. 6. BENCH TRIAL set for 1/10/2028 at 09:00 AM in LEXINGTON before Judge Karen K. Caldwell. Counsel present by 8:30 a.m. Trial length: 4 days. 7.
