ORDER: IT IS HEREBY ORDERED that pursuant to Federal Rules of Civil Procedure 15 and 21, the caption of this action is amended to name ST. LOUIS SPORTSERVICE, LLC as Defendant in place of DELAWARE NORTH COMPANIES SPORTSERVICE, INC.; that all prior filings and references to "Defendant" are deemed to refer to St. Louis Sportservice, LLC; that the correction relates back to the filing of the original Complaint under Rule 15(c); and that the Clerk of Court shall update the docket accordingly. IT IS FURTHER ORDERED that Defendant's Answer (ECF No. 39) is deemed the answer of St. Louis Sportservice, LLC to the Amended Complaint as so amended, and that all prior orders and agreements in this action, including the tolling agreement adopted in the Case Management Order (ECF No. 35), apply to and bind St. Louis Sportservice, LLC as if it had been correctly named from the commencement of this action.
