MINUTE ORDER re: 226 Status Report filed by Ronald Shear, Ronda Sterley, Buckley Recycle Center Inc. The following MINUTE ORDER is made by direction of the Court, the Honorable Ricardo S. Martinez, United States District Judge: On October 6, 2026, the parties filed the above joint status report pursuant to the Court's October 2, 2025, Order. That Order imposed a $1,000 a day sanction on Defendant Buckley "starting from July 15, 2025, until such time as it is no longer violating the Consent Decree." Dkt. #206 at 2. Once Buckley believed it was no longer violating the Consent Decree, it was to meet-and-confer with Plaintiff and file a stipulated motion with the Court ending the sanctions. Id. If the parties are unable to agree, they were to "make every effort to present reasonable paths forward for the Court modifying or pausing the sanctions and to include such in a joint filing." Id. In the above Joint Status Report, the parties disagree about whether or not Buckley is no longer violating the Consent Decree. They present alternative versions of the facts. They do not present any reasonable paths forward for the Court. Accordingly, the Court now DIRECTS Plaintiff Waste Action Project to file a motion to terminate sanctions and arguing for its calculation of the remaining costs for Defendant Buckley to be in compliance with the Consent Decree. This motion must be filed by October 22, 2026. The Court will review briefing from both sides in an effort to promptly resolve this matter. (CB)
