Case Management Conference Plan/Order. Case is assigned to the standard track, and is not suitable for Alternative Dispute Resolution or mediation at this time. The parties do not consent to the jurisdiction of the U.S. Magistrate Judge. Plaintiff anticipates filing a Motion for FLSA Notice to Potential Opt-In Plaintiffs. Accordingly, discovery shall proceed in 2 phases. Phase I: FLSA Notice to Potential Opt-in Plaintiffs: Fact discovery shall conclude on 11/15/2026. Plaintiff's motion for court-authorized notice, consistent with Clark v. A&L Homecare & Training Ctr., LLC, shall be filed by 12/16/2026. Defendants' opposition to such motion, if any, shall be filed by 1/15/2027. Plaintiff's reply in support shall be filed by 1/29/2027. If the Notice is authorized, there shall be a 60-day opt-in period. Phase II: Merits Discovery: Fact discovery shall conclude on 9/26/2027. The parties do not anticipate the need for expert discovery. Dispositive motions shall be filed in accordance with the schedule set for in Paragraph 16. A Telephonic Status Conference is set for 2/17/2027 at 12:00 p.m. Counsel for Plaintiff is to initiate the conference call by joining the other participants and calling the Court at (330) 884-7435. Parties' attendance is welcome, but not mandatory. Counsel should notify the Court in advance of a status conference if the matter has settled. Counsel shall comply with LR 37.1, which outlines a process for resolution of discovery disputes. On or before 7/22/2026, Plaintiff shall file a stipulation reached by the parties regarding the handling of trial-preparation material. Plaintiff shall file a supplement to the Complaint to include Exhibit A ("consent to sue" form) and Exhibit B (Plaintiff's employment agreement) by 7/22/2026. The cutoff for filing dispositive motions is 10/29/2027, with responses filed by 11/29/2027, and replies by 12/13/2027. Written stipulations as to all uncontested facts to be presented by the dispositive motion shall be filed with the Court on or before 10/29/2027 If there are no stipulations, a joint notice stating same shall be filed by the same date.
