~Util - Set Hearings Order
Order [non-document] The Court has reviewed the parties' Confidential Individual Status Reports, which were emailed to Chambers on August 17, 2026. Therein, the parties request that the Court extend the case management deadlines by ninety (90) days. The parties' request is granted as follows. Fact discovery shall be completed by December 15, 2026. The party initially seeking to introduce expert testimony shall exchange his or her Expert Report on or before January 18, 2027. Responsive Expert Reports shall be exchanged on or before February 17, 2027. Expert discovery shall be completed by April 19, 2027. Dispositive motions shall be filed by July 9, 2027. In their Reports, the parties also indicate that they have been addressing various disagreements regarding Defendants written discovery requests. Defendant requests that the Court cancel the status conference currently set for August 20, 2026 and reset it as an in-person conference with counsel and parties in thirty 30 days. Defendant suggests that the Court address any remaining discovery disputes at the rescheduled, in-person conference. Defendants request is denied. The Court finds as follows. The telephonic status conference currently set for August 20, 2026 is hereby CANCELLED. The parties are directed to meet and confer regarding the discovery disputes outlined in their Status Reports in accordance with this Court's Discovery Dispute Order (Doc. No. 11 -1) and Local Rule 37.1. If the parties are unable to resolve their disputes, they may file Position Paper(s) on the docket as set forth in this Courts Discovery Dispute Order. The Court will address any such disputes at that time. Lastly, the Court RESETS the telephonic status conference for December 9, 2026 at 1:30 p.m. Counsel shall use the previously provided dial in information. Counsel shall confer within five (5) business days of the scheduled conference to discuss outstanding issues and respective positions as to settlement. Counsel shall provide to the Court within three (3) business days of the conference, a joint Status Report or confidential individual Status Reports describing the status of discovery, including the timing and method of withholding information on the basis of claims of privilege or protected trial preparation materials, in compliance with Rule 26(b)(5)(A); settlement positions; and issues to be addressed. The Status Reports need not be filed, but may be delivered via email to Barker_Chambers@ohnd.uscourts.gov. Judge Pamela A. Barker on 8/18/2026. (P,K)
