PAPERLESS ORDER EXPEDITING BRIEFING re 64 : This matter is before the Court pursuant to Defendant Freedom Mortgage Corporation's Motion to Compel Discovery of Information Regarding Civil Money Penalties ("Motion") [DE 64]. The Court is quite frustrated and not at all pleased with the parties' last minute discovery antics. The discovery cutoff date in this case was April 18, 2024, the Plaintiff's Responses to the Second Set of Interrogatories were served on that very last date of the discovery cutoff (April 18, 2024), and the pending Motion to Compel was filed by Defendant on May 15, 2024. In light of the April 18, 2024 discovery cutoff deadline in this case [DE 16 at 5], and in light of the fact that the discovery motion was filed on the eve of the 28-day time period contemplated by S.D. Fla. L.R. 25.1(g)(2), the Court finds it necessary and appropriate to expedite briefing on the Motion. Accordingly, on or before May 21, 2024 at 5:00 p.m., Plaintiff CFPB shall file a Response to the Motion. Defendant shall thereafter file a Reply on or before May 22, 2024 at 5:00 p.m. The parties shall comply with the other provisions of the Court's Order Setting Discovery Procedure [DE 41] which they shall read before they file their respective response and reply. No extensions shall be granted absent the most compelling and extraordinary circumstances supported by affidavit or declaration. Once this briefing is completed, the Court shall either promptly rule on the papers or set an in-Court hearing requiring the personal attendance of all counsel. Additionally, the parties are also ORDERED to immediately personally confer by telephone, video conference, or in person as to each and every Interrogatory or discovery issue that is in dispute and then provide a Joint Notice on or before May 23, 2024 at 5:00 p.m. stating the nature of the conferral, the results of the conferral, and what, if anything, remains in dispute. Finally, the parties and their counsel are hereby put on notice that the Court shall consider the imposition of sanctions and cost shifting against any party and counsel who the Court finds is being dilatory, evasive, not following discovery rules or orders, or is taking an unreasonable discovery position.
