Order on Motion for Pre Motion Conference
ORDER granting 143 Motion for Pre Motion Conference. By August 5, 2026, Plaintiffs shall circulate their proposed Second Amended Complaint to the Defendants. Within seven business days of Plaintiffs' circulation of the proposed Second Amended Complaint to the Defendants, and no later than August 14, 2026, the Parties shall either (i) file a stipulation for leave to file the Second Amended Complaint and the Plaintiffs' Second Amended Complaint; or (ii) file a letter attaching the Proposed Second Amended Complaint and stating the basis for Plaintiffs proposed motion for leave to amend, and Defendants' opposition to Plaintiffs' filing of the proposed Second Amended Complaint. "[W]hen a party requests leave to amend [a] complaint, permission generally should be freely granted." Grullon v. City of New Haven, 720 F.3d 133, 139 (2d Cir. 2013) (citation modified). Defendants are encouraged to consider avoiding the expense and delay of any unnecessary motion practice. Consenting to the Plaintiffs' filing of a Second Amended Complaint will not preclude any Defendant from filing any future Rule 12 motions, including any motions to dismiss based on lack of personal jurisdiction.
If the Parties are unable to stipulate to the filing of the Second Amended Complaint, the Parties shall appear for an in-person, absent good cause, pre-motion conference on August 26, 2026 at 10 A.M. in Courtroom 6B South before Judge Kiyo A. Matsumoto. By August 18, 2026, the Parties shall file any request to appear remotely, including why there is good cause to grant such a request.
The Court adjourns the deadline for the Parties to submit a Rule 26(f) report to a date to be set by Magistrate Judge Lindsay after Plaintiffs file a Second Amended Complaint or a motion for leave to amend is resolved. The in-person conference scheduled for June 26, 2026 is hereby adjourned. Ordered by Judge Kiyo A. Matsumoto on 6/16/2026. (KSC)
