Status Report Order
SCHEDULING ORDER: Plaintiff is seeking certificates of default as to Defendants Irina Warkentin, Volodymyr Boichuk and Omex Data Service, LLC. ECF No. 17 . Certificates of default will not be issued at this time.
The initial conference in this action is converted to a default conference scheduled for 9/29/2026 at 11:30 AM before Chief Magistrate Judge Vera M. Scanlon; the CMP deadline is adjourned. To gain access to the ZoomGov audio conferencing system, counsel and/or any pro se parties are to dial 1-646-828-7666; enter meeting ID 16121901090 and press the pound key; when asked for a participant ID, press the pound key; and enter passcode 091622 and press the pound key. Please note that your microphone will be automatically muted when you enter the virtual conference room. If another conference is underway, please remain on mute until the case is called. Although Defendants Irina Warkentin, Volodymyr Boichuk and Omex Data Service, LLC ("Defendants") have not yet appeared in this case, they may appear at the conference. All Defendants in this action are encouraged to appear at the conference. The parties should expect to discuss Plaintiff's anticipated request for an entry of default. Plaintiff should refrain from filing further requests for certificates of default as to any Defendant in this action prior to the conference. Certificates of default will not be issued at this time.
Plaintiff has represented that Defendants have been served with the complaint, which is the document that states Plaintiff's claims against Defendants. See ECF No. 1 . Plaintiff asserts claims for, inter alia, racketeering and fraud. Because Defendants have not responded to this lawsuit by answering the complaint or moving to dismiss it, the Court may award damages against Defendants and in favor of Plaintiff should default be entered and should Plaintiff move for a default judgment, for which Defendants would be liable. If Defendants do not participate in the lawsuit now, they would likely waive the right to raise factual or legal defenses that they may have to Plaintiff's claims.
By 9/18/2026, Plaintiff must file a proof of service of this Order, the Complaint and the docket sheet upon Irina Warkentin, Volodymyr Boichuk and Omex Data Service, LLC. The Court will mail a copy of this Order to Irina Warkentin, 1545 Hobson Avenue, West Sacramento, CA 95605; Volodymyr Boichuk, 1736 Rodman St, Apt R, Hollywood, FL 33020 and Omex Data Service, LLC, 115 Office Plaza Dr., Ste A, Tallahassee, FL 32301.
