Order on Motion for Pre Motion Conference
ORDER: In light of the parties' 30 and 32 letters, the Court determines that a pre-motion conference is unnecessary. Per the Court's bundling rule, see Individual Rule IV.B.3, the government may serve, but not file, its motion to dismiss by 8/13/2026. Plaintiff shall serve a response by 9/14/2026. The government may serve a reply, if any, by 9/28/2026, and on that date, the parties shall file the complete, bundled motion papers in sequential order on ECF. Along with the motion papers, the parties shall file an administrative record containing the documents submitted by plaintiff to USPS on 4/28/2023 and 5/23/2023; the letters sent by USPS to plaintiff on 5/19/2023 and 1/23/2024; and any other documents necessary for the Court to decide the motion.
