Order on Motion to Compel
ORDER granting 120 Motion to Compel. Nonparty Decolator, Cohen & DiPrisco, LLP is directed to submit a certification that the records produced are authentic consistent with Federal Rule of Evidence 901as Decolator agreed to do at the conference held by this Court on July 21, 2026. (See 7/21/2026 Min. Entry and Order.) While the Court assumes a law firm is familiar with the language necessary to satisfy the authentication requirements of Fed. R. Evid 901, it appears that is not the case here. Accordingly, if accurate, Decolator is directed to provide Defendant Cunningham with a certification by 9/10/2026 including language that the records produced are true and correct copies of the records prepared and maintained by the law firm of Decolator, Cohen & DiPrisco, LLP in the ordinary course of its business.
Defendant Cunningham is directed to serve a copy of the Court's Order on Decolator, Cohen & DiPrisco, LLP and file proof of service on the docket on or before 8/28/2026. So Ordered by Magistrate Judge Lara K. Eshkenazi on 8/24/2026. (MED)
