Order Dismissing Case
TEXT ORDER entered by U.S. District Judge Sue E. Myerscough on 05/15/2026. The parties have filed a Stipulation to Dismiss With Prejudice (d/e 17 ). The joint Stipulation states that, pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii), this action is dismissed with prejudice and that each party shall bear its own attorney's fees and costs. Federal Rule of Civil Procedure 41(a)(1)(A)(ii) states that a plaintiff "may dismiss an action without a court order by filing... a stipulation of dismissal signed by all parties who have appeared." Both Plaintiff and Defendants, through their respective representatives, have signed the filed joint Stipulation (d/e 17 ). As a result, this case has been dismissed with prejudice. All pending deadlines and settings are VACATED. No judgment to enter. Each party to bear its own costs and attorney's fees. This case is closed. (DW)
