OPINION AND ORDER re: 18 JOINT MOTION to Dismiss (Notice of Motion). filed by Scandinavian Airlines System, Inc., Scandinavian Airlines of North America, Inc. For the reasons stated above, the Court GRANTS in part and DENIES in pa rt Defendants' motion to dismiss. Plaintiff's breach of contract claim survives. His conversion and unjust enrichment claims are preempted by the ADA and are dismissed. Meanwhile, Defendants' motion to strike Plaintiff's class claims are denied without prejudice to their ability to oppose class certification at a later date. Lastly, the Court denies Plaintiff leave to amend the dismissed claims. By separate Order, the Court will schedule an initial pretrial conference and direct the parties to submit a joint letter and proposed case management plan.
