MINUTE entry before the Honorable Matthew F. Kennelly: Video motion hearing held on 8/12/2026. Oral argument heard on defendant's motion to enforce MDL scheduling orders 531 is granted in part, denied in part, and entered and continued in part as stated on the record at today's hearing. The previously set joint status report deadline of 8/18/2026 525 is moved to 8/19/2026. Both sides are directed to contact IEH, GEA, and Charles River regarding compliance with the subpoenas served on those entities. The Court rules that the subpoena respondents may not resist the subpoena on the basis that the fact discovery completion deadline has now run; the subpoenas were served well in advance of that deadline. The Court will entertain any motions relating to compliance with or the scope of the subpoenas if and when they are presented. Plaintiffs' counsel stated on the record that with the possible exception of IEH and Charles River they do not expect to take depositions of the subpoena respondents subject to the parties reaching an understanding regarding business record admissibility of materials produced by the respondents. The parties are directed to promptly meet and confer regarding that issue. By no later than 8/19/2026, the parties are directed to file a comprehensive joint status report (consistent with the Court's comments on the record) regarding their communications with IEH, Charles River, and GEA regarding the subpoenas or subpoena compliance.
