Protective Order
CONFIDENTIALITY STIPULATION AND PROTECTIVE ORDER...regarding procedures to be followed that shall govern the handling of confidential material...SO ORDERED (Signed by Magistrate Judge Andrew E. Krause on 10/13/2026) (ks)
Order
ORDER: The Court has reviewed the parties' proposed confidentiality order (ECF No. 26 at 3-6), which requests relatively minor changes to the Court's standard form order. The Court will sign the proposed order, and will docket that order separately. To be clear, however, the language in paragraph 9 of the Court's standard form order is intended, in part, to convey to the parties that just because a document is designated by one party or the other as "Confidential" pursuant to the order does not automatically mean that the document meets the legal criteria for filing under seal. Through their edits, the parties have created a default rule for themselves in this case that anything that is designated as "Confidential" and is filed with the Court will automatically be submitted for filing under seal. But the parties must understand that their own confidentiality designations are not dispositive with respect to an application to file under seal, and the parties should not assume that the Court will approve an application for a document (or a portion of a document) to be sealed just because it has been marked as confidential by one of the parties. (HEREBY ORDERED by Magistrate Judge Andrew E. Krause) (Text Only Order)
