Initial Conference Hearing Pre Motion Conference ~Util - Set Deadlines
MINUTE ENTRY AND ORDER: A pre-motion conference was held on July 8, 2026 before Magistrate Judge Peggy Kuo. Rania Sedhom, Esq. appeared on behalf of Plaintiff. Tereza Horakova, Esq. appeared on behalf of Defendants.
The attached Scheduling Order was entered setting deadlines for discovery and other pretrial proceedings.
Plaintiff stated that it will consider removing tort claims that are duplicative of its breach of contract claim but contended that its misappropriation of trade secrets claim is a separate cause of action. The parties are directed to confer regarding the Complaints tort claims and file a joint status letter by July 24, 2026 indicating whether they have reached an agreement on what tort claims, if any, will be briefed in the motion to dismiss.
The parties are further directed to engage in discovery concerning personal jurisdiction issues and Defendant Vivatech SRL. By August 19, 2026, the parties are directed to file a joint letter with a proposed briefing schedule for a motion to dismiss or a deadline for Defendants to answer the Complaint. The joint letter must also indicate how the parties intend to proceed with this action and the related case Jos. H. Lowenstein and Sons, Inc. v. Aguiar, 25-cv-5789, including whether a combined settlement conference on September 9, 2026 with both matters would be beneficial.
