ORDER DISMISSING CASE: On September 21, 2026, Plaintiff filed a notice of voluntary dismissal seeking to dismiss this action without prejudice under Fed. R. Civ. P. 41(a)(1)(A)(i) in light of the fact that Defendants had not filed an answer or a motion for summary judgment. (ECF No. 17 ). The Court instructed Defendant to file a response by September 30, 2026 to the extent it had a contrary position as to whether dismissal without prejudice is permissible in this procedural posture. (Elec. Order, Sept. 23, 2026.) Defendant failed to file any response. Accordingly, the case is dismissed without prejudice pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i) in light of the Plaintiff's Notice of Dismissal (ECF No. 17 ). Case Closed. Ordered by Judge Nusrat J. Choudhury on 10/2/2026. (JAG)
