Minute Entry for proceedings held on 7/14/2026 before Magistrate Judge Lee G. Dunst: Civil Cause for Initial Conference. Counsel for Plaintiff: Michael Samuel. Counsel for Defendant: Joshua Adam Scerbo. FTR #: 1:04-1:10, via Zoom. Case called. Counsel for all sides present. For the reasons stated on the record, the parties joint proposed schedule at DE 18 is APPROVED as follows: (1) automatic disclosures required by Federal Rule of Civil Procedure 26(a)(1) by 7/20/2026; (2) fact discovery by 11/18/2026; (3) all discovery by 11/25/2026; and (4) the final date to take the first step in dispositive motion practice, if any, consistent with the Individual Practice Rules of District Judge to be assigned to this case (or the undersigneds Individual Practice Rules should the parties consent to the jurisdiction of the undersigned for all purposes), is 12/22/2026. The Court currently declines to set a deadline for the completion of preliminary discovery or schedule a date for an initial settlement conference. Additionally, any motion to amend the pleadings to add claims or join additional parties must be filed by 8/15/2026. Any such motion filed on or after 8/16/2026 will be denied absent a showing of good cause under Fed. R. Civ. P. 16(b)(4). See Sacerdote v. New York University, 9 F. 4th 95, 115 (2d Cir. 2021). The parties are advised that this case has been assigned to the Direct Assignment Program pursuant to Administrative Order 2025-14. The parties must review and submit either (1) a Magistrate Jurisdiction Consent Form, or (2) a Direct Assignment Acknowledgement Form, indicating that they have conferred regarding consenting to magistrate judge jurisdiction. These forms can be found at https://www.nyed.uscourts.gov/bulletin-direct-assignment-program. The parties shall submit either of these forms by 7/21/2026.
