Order on Motion for Leave to File Document Order on Motion to Serve
ORDER granting 42 Letter Motion for Leave to File Document; granting 43 Motion to Serve. Pursuant to the discussion at the telephonic conference held today, September 16, 2026 (the "Conference"), the Court ORDERS as follows: 1. Should the parties wish to order a copy of the Conference transcript, they may do so by using the annexed form. 2. The briefing schedule for the anticipated motion for judgment on the pleadings by Defendants Jess Ting, Solomon Schwartz, New York Eye and Ear Infirmary, Mount Sinai Health System, Inc., and Beth Israel of Mount Sinai (together, the "Mount Sinai Defendants") is VACATED. (Dkt. No. 39). 3. By September 18, 2026, Plaintiff Dee Deidre Farmer ("Ms. Farmer") shall provide to counsel for the Mount Sinai Defendants the emails concerning Alicia Rivera discussed during the Conference. 4. By September 21, 2026, the Mount Sinai Defendants shall provide Ms. Farmer with a stipulation of dismissal as to Defendant Mount Sinai Hospital. 5. Ms. Farmer's request for leave to file a Second Amended Complaint (the "SAC") at Dkt. No. 43 is GRANTED. By October 9, 2026, Ms. Farmer shall file the SAC. 6. By November 13, 2026, the Mount Sinai Defendants shall answer, move, or otherwise respond to the SAC. Should the Mount Sinai Defendants choose to file a motion to dismiss pursuant to Federal Rule of Civil Procedure 12 (the "Motion"), the Court sets the following briefing schedule: a. By November 13, 2026, the Mount Sinai Defendants shall file the Motion. b. By December 16, 2026, Ms. Farmer shall file her opposition to the Motion. c. By January 5, 2027, the Mount Sinai Defendants shall file their Reply. The Clerk of the Court is respectfully directed to close Dkt.
