SCHEDULING ORDER. In her Complaint, Plaintiff asks "this Court [to] appoint an umpire regarding the disputes of actual cash value, replacement cost value, and additional living expenses portion of her claim against Defendant [under an insurance policy], and that she have such other and further relief as the Court deems just and equitable." (Doc. 1-1, pg. 6). On June 10, 2025, the parties filed an Agreed Motion to Stay Proceedings Pending Ruling, which, in part, stated: "At this time, a stay of the proceedings is appropriate. Specifically, if the Court grants Liberty Mutual's Motion to Dismiss, the case will be dismissed without prejudice until such a time as Plaintiff complies with the post-loss duties and Liberty Mutual can accept the appraisal demand, if appropriate. Alternatively, if the Court denies Liberty Mutual's Motion to Dismiss, Defendant will then answer the petition to appoint the umpire and submit a counter-petition with its own slate of proposed umpire candidates. Under either of the above scenarios, no written discovery is required, no oral discovery is required, no fact discovery is required, no expert discovery is required, and no motion practice beyond that involving the Motion to Dismiss is required--either the litigation is dismissed or the Court rules on the parties' cross-petitions and appoints an appraisal umpire, at which time the case closes." (Doc. 18, pg. 3). The Court granted that Agreed Motion and stayed the case. (Doc. 19). On October 22, 2025, the Court denied Defendant's Motion to Dismiss, lifted the stay of the case, and directed Defendant to file an answer within 14 days. (Doc. 20). Defendant filed its Answer and Affirmative Defenses and Counterclaim for the Appointment of an Appraisal Umpire, and Plaintiff filed an Answer to the Counterclaim for the Appointment of an Appraisal Umpire. (Docs. 21 & 22). Thereafter, Plaintiff filed a Motion for Summary Judgment and Supporting Memorandum, and Defendant filed a Motion for Judgment on the Pleadings. (Docs. 23 & 24). Those Motions ripened on February 27, 2026. In light of the parties' statements, as well as the nature of their pending Motions, the Court VACATES the Final Pretrial Conference and Bench Trial dates of May 7 and 18, 2026, respectively, at this time.
