ORDER -- The parties have inquired via email into what extent defendant Sprei must testify regarding an entity discussed as part of settlement proceedings. The Court informed the parties involved in the settlement proceedings that the settlement proceedings were confidential and the Court sees no basis for permitting inquiry into those confidential proceedings. Indeed, doing so would subvert the purpose of FRE 408. To the extent Plaintiffs have sources of information other than the confidential settlement discussions, the fact that a topic was discussed as part of the settlement proceedings does not preclude Plaintiffs from inquiring into the underlying facts.
Plaintiffs are permitted to inquire into facts surrounding ownership interests, valuation, assets, or other facts relevant to damages or fund tracing, but the Court will not disturb the confidentiality of the settlement negotiations. To the extent any portion of the deposition transcript reveals information covered by the Court's 66 Protective Order, those portions of the transcript shall be designated in accordance with the Protective Order.
