Walter. For the foregoing reasons, Counterdefendants' Motion to Stay Proceedings Pending Resolution of Parallel State Court Action is GRANTED. In light of the stay of this action, Counterclaimants Ex Parte Application to Modify the Scheduling Order By Reopening and Extending the Dispositive-Motion Hearing Deadline Pursuant to Federal Rules of Civil Procedure 16(b)(4) and 6(b)(1)(B); or in the Alternative, For Leave to Refile Counterclaimant's Motion for Summary Judgment is DENIED without prejudice to re-filing after the stay is lifted. The parties shall file a Joint Status Report within fourteen days of any substantive ruling in the Virginia Action concerning Counterclaimant's Plea in Bar and thereafter every 120 days, unless otherwise ordered by the Court.
