MINUTE ORDER (IN CHAMBERS) ORDER TO SHOW CAUSE by Judge Hernan D. Vera. The Court is in receipt of the Stipulation to Dismiss the Complaint with Prejudice ("Stipulation") filed by Plaintiff, [Dkt. 58], and the Urgent Notice of Nonconcurrence and Objection to Plaintiff's Unauthorized Stipulation to Dismiss ("Objection") [Dkt. 59]. The Court is also in receipt of Plaintiff's Notice of Withdrawal of Stipulation to Dismiss Case. [Dkt. 60]. In light of these filings, Plaintiff is ordered to show cause whether and why it filed the Stipulation without Defendants' consent. The Court notes, however, that pursuant to Federal Rule of Civil Procedure 41, a plaintiff may dismiss a case without consent of the opposing party or the court where, as here, the opposing party has not yet filed an answer or a motion for summary judgment. Plaintiff is therefore also ordered to inform the Court whether it still intends to dismiss the case. (lom)
