Notice of Filing - Proposed Pretrial Order
NOTICE of Filing - Proposed Pretrial Order filed by Jacob Robbins (Suffecool, Christopher)
Order
ORDER: The Court has reviewed the deposition transcript excerpts filed by Zaccardo (Doc. 111 ) and Defendants' response including the Declaration of Susan Smith (Docs. 112 , [112-1]). The Smith Declaration states under penalty of perjury that the original hard-copy records maintained in the ordinary course of business have been located and produced to Zaccardo, and that the declarant is aware of no additional original hard-copy records for the Repair Orders. (Doc. [112-1].) Consistent with the Court's statements at the June 25, 2026 hearing, the Court cannot order production of documents that do not exist. Zaccardo's request for further relief is denied. Zaccardo remains free to raise any arguments regarding the completeness of the production or the existence of documents in connection with dispositive motion practice. Ordered by Judge Sharad H. Desai on 7/10/2026. This is a TEXT ENTRY ONLY. There is no PDF document associated with this entry. (RMW)
