ORDER: Before the Court is Defendant/Counterclaim-Plaintiff Capital Express, LLC's ("Capital Express") Renewed Motion for Clerk's Entry of Default against Plaintiff Truck Norris, LLC ("Plaintiff"). (Doc. # 29 .) Upon review, the Court finds that this case is in its early stages, and a scheduling conference is set for October 7, 2026. The Court further finds that this case should be resolved on the merits. An entry of default would cause severe prejudice to Truck Norris. Accordingly, it is hereby ORDERED that Capital Express's Renewed Motion for Clerk's Entry of Default (Doc. # 29 ) is DENIED. It is further ORDERED that Plaintiff's Motion to File Answer to Counterclaim Out of Time (Doc. # 32 ) is GRANTED. Plaintiff's Counterclaim Answer (Doc. # 31 ) is deemed to be properly filed.
