Initial Conference Hearing

THE FOLLOWING RULINGS WERE MADE:Following discussion with counsel during the Initial Conference, the parties expressed the desire to have this matter directly assigned to the undersigned for all purposes. The parties are directed to review Docket Entry No. 4 , concerning the assignment of a Magistrate Judge to oversee this case and Administrative Order No. 2025-14. By June 24, 2026, the parties MUST review and file the Notice of Option to Consent to Magistrate Judge Jurisdiction form consenting to the jurisdiction of the undersigned.
The parties further agreed that discovery was not warranted in this case, and the following briefing schedule was set as to Plaintiff's anticipated Motion for Summary Judgment:(i) Plaintiff's motion and the administrative record are to be filed and served on or before November 13, 2026.(ii) Defendant's opposition is to be filed and served on or before December 18, 2026.(iii) Plaintiff's reply is to be filed and served on or before January 15, 2027.The Court waived the Rule 56.1 requirement and granted leave to include an additional ten (10) pages in the parties' briefs.

STATUS REPORT ORDER: Having considered Plaintiffs' response to the Court's June 17, 2026 Order to Show Case ("OSC"), in particular, that the parties have reached a settlement in principle and are finalizing said settlement (see OSC Response, paras. 3 & 4), Plaintiffs have promptly and sufficiently shown cause why this case should remain open. Further, in accordance with Plaintiffs' representations, by no later than July 31, 2026, the parties are to file either (1) a Status Report informing the Court of the procedural posture of the parties' settlement, or (2) a Stipulation of Dismissal.
