ORDER - Re 257 Notice of Hearing, 258 Discovery Conference. The Court finds that Mr. Gross's deposition can continue as planned for September 15, 2026, if indeed that is the manner in which Plaintiffs seek to obtain the information. As explained at the discovery conference, the Court further grants Defendants leave, pursuant to Federal Rule of Civil Procedure 30(a)(2)(A)(ii), to conduct another deposition of Mr. Gross at a later date. Finally, the Court did not address the issue of whether Mr. Gross should be characterized as an expert, but notes that Defendants have preserved that objection to be raised at a later date, if needed.
