TEXT ORDER denying 73 Letter Request for Conference and for Extension of Time. On September 3, 2026, the Court entered a Decision and Order granting Plaintiff's motion to compel (Dkt. 68) and reopening discovery for a period of 30 days for the limited purposes of permitting Defendant to respond to Plaintiff's third set of document requests and conducting Defendant's Rule 30(b)(6) deposition (Dkt. 72). Of note, Defendant's Rule 30(b)(6) deposition was originally noticed for February 10, 2026, approximately eight months ago. (See Dkt. 68-11 at 1; Dkt. 72 at 4). Plaintiff's third set of document requests was served on January 5, 2026, approximately nine months ago. (See Dkt. 68 at 10; Dkt. 72 at 3).
Defendant has now filed a letter requesting "a conference with the Court and the Plaintiff's attorneys, as soon as possible, to discuss [Defendant's] production of documents in discovery,' as well as "the Court's guidance on the timing and document scope of the FRCP 30(b)(6) deposition." (Dkt. 73 at 1). Defendant further requests "an additional two weeks to complete the production" due to the "tremendous amount of documents" involved. (Id.).
Defendant's request is denied. The Court's Order regarding the timing of Defendant's production of documents and the Rule 30(b)(6) deposition was clear and requires no further guidance or clarification. To the extent Defendant seeks an extension of time, it must file a formal motion that addresses the applicable legal standard and provides a factual basis on which the Court could find good cause for such an extension. If Defendant objects to the scope of Plaintiff's Rule 30(b)(6) notice, it may move for a protective order. See Dongguk Univ. v. Yale Univ., 270 F.R.D. 70, 74 (D. Conn. 2010) (noting that "[t]he burden of proof lies with the party opposing discovery to show good cause to deny the discovery sought"). SO ORDERED. Signed by Hon. Colleen D. Holland on 10/02/2026.
