   Minute entry for INITIAL CONFERENCE before Judge Charles Eskridge on July 29, 2026. All parties present and represented by counsel. The Court addressed the joint discovery/case management plan. Dkt 34. It was noted that the parties reference a related action in state court in which Plaintiff Elizabeth Fagen seeks judicial review of a decision by the Texas Commissioner of Education regarding her termination. See id at 1, citing Fagen v Humble Independent School District, No 202527299 (80th Dist Ct, Harris County, Tex). The parties stated that a hearing is set in that matter for September 14, 2026. Counsel for Defendant Humble Independent School District further stated that a decision in that action may provide a basis to assert res judicata in this action. The Court addressed the potential for settlement. The parties stated willingness to mediate this action in the future. But they stated that attempt at resolution was unlikely to be productive at present given the motion by Defendant to dismiss. The Court addressed the motion to dismiss. Dkt 33. Defendant requested that the undersigned take judicial notice of (i) the decision of the Commissioner, (ii) Plaintiffs charge of discrimination filed with the Equal Employment Opportunity Commission, (iii) her original petition filed in the pending state court action, and (iv) the independent hearing examiners findings of fact and conclusions of law. It was noted that all but the last of these had been attached to the motion to dismiss. See Dkts 33-1, 33-2 & 33-3. Upon inquiry, counsel for Plaintiff stated no objection, so long as ability to respond with views on each was provided. It was ORDERED that judicial notice would be taken of the above materials with consideration of the motion to dismiss. Plaintiff requested leave to file a sur-reply addressing arguments in Defendants reply brief as to (i) relation-back, (ii) exhaustion, (iii) the Texas Open Meetings Act, and (iv) the existence of an impartial decision-maker. See Dkt 45 at 48, 10. Upon inquiry, Defendant stated no opposition to Plaintiff filing a sur-reply on such points. Further argument on the motion to dismiss was thus HELD IN ABEYANCE. Dkt 33. Plaintiff was GIVEN LEAVE to file a sur-reply on the requested points by August 12, 2026, along with any further statement as to the matters granted judicial notice. The parties were ORDERED to provide a joint status report by September 21, 2026, regarding the hearing in the pending state court action. The parties may also there request opportunity to brief any further issues arising from or related to that hearing. This matter is SET for further hearing on the motion to dismiss on October 7, 2026.
