Status Conference ~Util - Set Deadlines/Hearings
Minute Entry for Status Conference proceedings held on 5/3/2024 before Magistrate Judge James R. Cho. Appearances by James W. Meehan and Mary Diaz for plaintiff. Pro se defendant Matthew Morgan ("Morgan") failed to appear for the conference despite a reminder by email to join the conference and attempts to reach him by telephone.
Discussion held regarding 76 plaintiff's motion to dismiss pursuant to Rule 41(a)(2). Although Mr. Morgan has executed the settlement agreement, plaintiff's counsel has been unable to reach Mr. Morgan to execute a stipulation of dismissal. Plaintiff's counsel shall continue to attempt to reach Mr. Morgan, including through his former counsel, Amy J. Zamir.
Counsel for plaintiff and Mr. Morgan are ordered to appear for a Telephone Status Conference on 5/17/2024 at 2:00 p.m. before Magistrate Judge James R. Cho. Parties are directed to call 833-990-9400 and enter Meeting ID 709-478-501#. Counsel for plaintiff shall email a copy of this Order to Mr. Morgan, and file proof of service on ECF. Counsel shall also call Mr. Morgan to remind him of the conference.
Mr. Morgan is warned that his continued failure to comply with Court orders and appear at conferences may result in a recommendation to the District Judge that his counterclaims be dismissed. (Cisco Recording). (EJS)
