Order on Motion to Continue
PAPERLESS ORDER denying 205 Motion to Continue. The request for expedited treatment is granted but Respondent's motion to continue the currently set evidentiary hearing is Denied based on the absence of any persuasive good cause shown. Indeed the materials submitted in support of the motion actually show that Defendant can be available to defend his position and appear to provide testimony at the scheduled evidentiary hearing. A mediation date set in a state court matter for the week after the hearing is hardly a scheduling conflict. Nor is Respondent's business interests a matter that supports good cause in a proceeding where Respondent has had the means to resolve the alleged violations for some time, and in which Respondent has a judgment entered against him that remains unsatisfied after much time. Finally, the status of Respondent's failures to provide required discovery, even in response to Orders of this Court, has been ongoing since at least January. No further continuances are thus warranted and none are Granted.
Signed by Magistrate Judge Edwin G. Torres on 4/21/2026. (EGT)
