Order on Motion for Attorney Fees
ORDER granting 26 Joint MOTION for Attorney Fees. Having reviewed the motion, the Court finds that the parties corrected the 24 Stipulation's deficiencies identified at Docket Number 25. The Court finds that the proposed fee award -- constituting 23.3 hours of work at a rate of $244.62 ($125 plus a cost of living adjustment) -- is reasonable and complies with the Equal Access to Justice Act (EAJA), 28 U.S.C. § 2412. The Commissioner shall pay to the plaintiff attorney fees in the amount of $5,699.64, pursuant to the EAJA, 28 U.S.C. § 2412, in full satisfaction of any and all claims under the EAJA. The attorney fees may be paid to plaintiff's counsel if the plaintiff agrees to assign the fees to counsel, and provided that the plaintiff owes no debt to the Federal Government that is subject to offset under the U.S. Treasury Offset Program. Further, as stipulated by the parties, plaintiff's counsel is awarded additional costs in the amount of $402.00, pursuant to 28 U.S.C. § 1920. It is so ordered. Signed by Judge Robert M.
