Order ~Util - Case Unsealed Terminate Motions
ORDER: 1. The United States' Motion [R. 8 ] is GRANTED; 2. The Relators' Complaint [R. 1 ] shall be UNSEALED; 3. This Order and the United States' Notice of Election to Intervene-in-part and to Decline-in-part shall be UNSEALED; 4. The filings at [R. 4 ; R. 6 ; R. 7 ] shall REMAIN UNDER SEAL and not be made public or served upon the Defendants, as these documents were provided pursuant to 31 U.S.C. § 3730(b)(3) to apprise the Court alone of non public information relating to the Governments investigation, for the purpose of evaluating whether the seal and time for making an election to intervene should be extended, or whether the seal should be partially lifted; 5. The seal shall be lifted on all other contents of the Court's file; 6. The seal shall be lifted as to all other matters occurring in this action after the date of this Order; 7. The Relators shall serve their Complaint upon Defendants within ninety (90) days from the entry of this Order; 8. As to the part of this action in which the United States has declined to intervene, the Parties shall serve on the United States all pleadings and motions filed in this action, as provided for in 31 U.S.C. § 3730(c)(3); 9. The United States may order any deposition transcripts; 10. The United States shall receive electronic notice of all orders filed in this action; 11. The United States may intervene in the declined portion of this action, for good cause shown, at any time; and 12. Should the Relators or the Defendants propose that the part of the action in which the United States has declined to intervene be dismissed, settled, or otherwise discounted, the Court will solicit the written consent of the United States before ruling or granting its approval.
