Order on Motion to Extend Time
ORDER granting 43 Motion to Extend Time to File Second Amended Complaint. On May 29, 2026, I granted the Plaintiff's motion for leave to file a second amended complaint, and set a deadline of June 12, 2026 for that filing. One week before the deadline, the Plaintiffs, who are unrepresented, filed a motion to allow them until July 13, 2026 to file the second amended complaint, due to the complexity of the legal and factual issues to be addressed in the second amended complaint. On June 18, 2026, the Marquis defendants filed an opposition to the motion to extend time. On June 24, 2026, two and a half weeks before the requested extended deadline, the Plaintiffs filed the second amended complaint. There is no prejudice created by virtue of the brief extension requested, the filing should not impact the overall discovery and other deadlines in the case, the request was made well before the first deadline I imposed expired, and the Marquis defendants do not set forth any arguments otherwise. The motion is therefore granted and the second amended complaint, filed today, is deemed timely. By MAGISTRATE JUDGE KAREN FRINK WOLF. (WOLF, KAREN)
