   CONSENT JUDGMENT AND PERMANENT INJUNCTION (DKT. 38 ) by Judge John A. Kronstadt. It is hereby ORDERED, ADJUDGED, and DECREED as follows: Defendant I Smoke Wholesale LLC, together with their officers, agents, servants, employees, and all others in active concert or participation with it, are hereby PERMANENTLY ENJOINED from: a. Using any counterfeit BIC trademark, as defined in 15 U.S.C. § 1127, in connection with the sale, offering for sale, distribution, or advertising of any good or service in commerce; and b. Using any mark in connection with the sale, offering for sale, distribution, or advertising of any good or service that is likely to cause confusion as to whether BIC is affiliated or associated with, or sponsors or endorses, the goods and services offered by Defendant. Notwithstanding the foregoing, Defendant I Smoke Wholesale LLC shall be permitted to use BIC's registered trademarks to the extent it is in connection with the lawful sale or resale of genuine BIC products and consistent with the law of fair use. Defendant I Smoke Wholesale LLC shall pay $150,000.00 to Plaintiffs BIC Corporation and BIC USA Inc. Payment shall be made pursuant to the agreement of the Parties. Any request for any other relief is DENIED. The Court shall retain jurisdiction over this Consent Judgment in its entirety, the parties hereto, and any action in connection with the enforcement of the Consent Judgment. IT IS SO ORDERED. (chk)
