MINUTES OF PROCEEDINGS - Status Conference held on 7/6/2026 before Magistrate Judge Elayna J. Youchah. The Court summarizes the previous proceedings and makes opening remarks. Government Counsel represents which items have been produced to them and which are still missing, and makes recommendations for sanctions. Defense Counsel makes representations. The Court makes additional remarks regarding it's inclinations for potential sanctions and hears further remarks of Counsel. The Court makes findings for the record.
IT IS ORDERED: The Court finds Rule 37 sanctions are appropriate and Defendant is sanctioned as follows:
1) Defendant must pay, into the general fund of the U.S. District Court of the District of Nevada, all fees and costs incurred by the Government from it's Motion to Compel 60 and all subsequent efforts made thereafter to attempt to obtain compliance. A Memorandum regarding fees and costs is due 7/20/2026 and Defendant's response is due 7/27/2026. The Court will enter a separate order regarding the final amount to be paid and when it will be due.
2) Defendant is precluded from offering any evidence of any kind, testimonial or documentary, in addition to that which she has produced to date as of 7/06/2026. Anything Defendant discovers from this point forward is deemed inadmissible.
3) Government will provide the specific language for an adverse inference with their Memorandum due 7/20/2026, as directed in open court, with respect to Defendant's accounts in the Cayman Islands and in Canada. This adverse inference will be read to the jury if this case reaches jury trial, or the Court will take it as an adverse inference if this case proceeds to a bench trial.
Government raises the need for dates regarding Defendant's deposition and dispositive motions, as well as the due date for the Joint Pretrial Order. Defense Counsel makes remarks.
IT IS ORDERED: Defendant's deposition must take place before 9/15/2026. Defendant must be available to appear as directed, and no extensions will be granted.
Motions for Summary Judgement are due 10/30/2026. Due dates for oppositions and reply are set by Local Rule 7-2. The Joint Pretrial Order will be due 30 days after the dispositive motions are ruled on. Motions in Limine are likewise set in accordance with the Local Rules and Counsel should contact the District Judge if they request any continuances of those trial related deadlines.
The Transcript will serve as the written Order of the Court.
