Order [non-document] The Court has reviewed the parties' joint status report in anticipation of the status conference set for 06/11/2026. The parties represent that they are engaged in discovery and do not anticipate deviating from the current case management deadlines. Further, the parties did not represent that there are any pending issues that need to be addressed prior to the close of non-expert discovery on 09/10/2026. Accordingly, the status conference set for 06/11/2026 is cancelled. The Court will reset the status conference for Thursday, September 17, 2026 at 1:30 p.m. The parties should use the telephone conference instructions that were previously emailed to them. Counsel again shall confer within five (5) business days of the scheduled conference to discuss outstanding issues and respective positions as to settlement. Counsel shall provide to the Court within three (3) business days of the conference, a joint Status Report or confidential individual Status Reports describing the status of discovery, including the timing and method of withholding information on the basis of claims of privilege or protected trial preparation materials, in compliance with Rule 26(b)(5)(A); settlement positions; and issues to be addressed. The Status Reports need not be filed, but may be delivered via email to Barker_Chambers@ohnd.uscourts.gov. Importantly, in the parties' most recent report, they fail to address "the timing and method of withholding information on the basis of claims of privilege or protected trial preparation materials, in compliance with Rule 26(b)(5)(A)."
