Third-Party Defendants hereby dismiss with prejudice each and every counter - and cross-claim asserted either against Buckeye and/or against one another. For the avoidance of doubt, Buckeye through this stipulation is not dismissing its First Third-Party Complaint against YAD Associates, Inc., Pyramid Company of Onondaga, Suzanne M. Congel and Douglas E. Ulrich, as Co-Executors of the Estate of Robert J. Congel, and Bruce A. Kenan ("YAD Defendants") (see ECF No. 38 ); nor are the YAD Defendants dismissing any claims they may have against Buckeye and/or ExxonMobil; nor is ExxonMobil dismissing any claims it may have against the YAD Defendants (see ECF No. 290 ); rather, Buckeye, the YAD Defendants, and ExxonMobil will seek to sever the remaining claims by and amongst them from the Consolidated Cases. Signed by Senior Judge Frederick J. Scullin, Jr on May 13, 2024. (rep)
