[IN-CHAMBERS TEXT ONLY ORDER]:
The Court has reviewed the Parties' statements and Joint Status Report. [Dkts. 170 , 171 , 172 ]. In light thereof, the Court:
(a) GRANTS SlumberPod's unopposed request [Dkt. 171 at 2] to modify the Pretrial Conference Order's [Dkt. 169 ] deadline for Oppositions to Motions in Limine and the deadline for the Joint Status Report from Sept. 18 to Sept. 21;
(b) CLARIFIES that the Pretrial Conference Order [Dkt. 169 ] inadvertently referenced Daubert motions, CONFIRMS that the Parties' original deadline to file Daubert motions was set by Judge Wise [Dkt. 100 ], and therefore the deadline has passed and no further Daubert motions are allowed; and thus to the extent the Pretrial Conference Order [Dkt. 169 ] references Daubert motions and deadlines associated with such motions, those deadlines are vacated as MOOT; and
(c) GRANTS the joint motion for clarification [Dkt. 172 ], CLARIFIES that the Court expects the Parties to file a Final Pretrial Statement, CLARIFIES that the Court did not address the deadline or contents of the Final Pretrial Statement in the Pretrial Conference Order because the Court's intention is to issue shortly a Trial Order which will address those issues, and as such the Parties should expect to file their Final Pretrial Statement on September 8, 2026. The Court's Trial Order will issue separately and will address the issues such as contents of the Final Pretrial Statement.
