MEDIATION REFERRAL ORDER: The Court is in receipt of the Parties briefing on the pending motion to dismiss. [ECF Nos. 22, 24, 30]. Plaintiffs request for leave to file her opposition nunc pro tunc, [ECF No. 25], is GRANTED over Defendants opposition, [ECF No. 26]. Defendant also requests that the Court refer this matter to mediation and hold the motion to dismiss "in abeyance until the mediation has concluded." [ECF No. 26] at 1; see also [ECF Nos. 27, 28]. That request is GRANTED. Accordingly, it is hereby ORDERED that this case is referred for mediation to the Court-annexed Mediation Program. The parties are notified that Local Rule 83.9 shall govern the mediation and are directed to participate in the mediation in good faith. Defendants motion to dismiss, [ECF No. 21], is DENIED without prejudice to renewal by refiling should mediation efforts prove unsuccessful. To that end, it is FURTHER ORDERED that the Parties shall provide the Court with an update on the statusbut not the substanceof mediation on or before August 1, 2026, and every thirty days thereafter.
