SCHEDULING ORDER: As set forth on the record during the initial conference held today, the parties are directed to confer and by January 14, 2027, submit a joint status letter setting forth whether the case has settled. If the case has not settled, the letter should also include a joint proposed discovery plan.This case has been assigned to Judge Shields through the EDNY Direct Assignment Program, which is established by Administrative Order 2025-14. More information about the program can be found at https://www.nyed.uscourts.gov/bulletin-direct-assignment-program. Pursuant to the Administrative Order, the parties are directed to discuss whether they will consent to Magistrate Judge Shields for all purposes. Either or both parties may withhold consent to the magistrate judge without adverse substantive consequences. If all parties consent, they should file a fully executed form to consent to Judge Shields for all purposes (available at https://www.nyed.uscourts.gov/sites/default/files/uploads/mjconsentform.pdf). If any parties do not consent, the parties should file a fully executed form acknowledging their obligation to confer regarding consent (available at https://www.nyed.uscourts.gov/sites/default/files/uploads/direct assignment program acknowledgement.pdf). Then, a District Judge will be selected at random to be assigned to this matter. Counsel must submit one of these forms by October 21, 2026. So Ordered by Magistrate Judge Anne Y.
