(This is a TEXT ENTRY ONLY. There is no pdf document associated with this entry.) ORDER denying in part 4 Emergency Motion for Temporary Restraining Order and Preliminary Injunction. To the extent this Motion seeks an emergency ex parte TRO, the Court denies the Motion. Although Plaintiff has numerous complaints concerning the NAD process, his principal basis for seeking an emergency ex parte TRO is that holding the September 18 hearing by video or telephone would violate 7 U.S.C. § 6997(c)(2). But the TRO request was not filed until late in the afternoon on September 17. And it appears from the record that Plaintiff knew about the September 18 hearing for many weeks. Plaintiff's delay in filing this motion is enough on its own to justify a denial of the ex parte TRO request. And this is true even though Plaintiff did not learn until September 14, 2026, that the ALJ would not address certain motions (which had been pending since August) until the September 18, 2026 hearing. Plaintiff cannot sit on his rights for days or weeks and then suggest the existence of an emergency requiring a TRO without input from the other side. Signed by Judge Lee P. Rudofsky on 9/18/2026. In short order, the Court will screen Plaintiff's Complaint in accordance with the in forma pauperis statute and determine whether to order service on the named Defendants. In the event that the Complaint passes screening, the Court will order service of the Complaint and the TRO/Preliminary Injunction papers on the named Defendants--but it remains Plaintiff's responsibility to provide service addresses for the Defendants. Plaintiff must provide those service addresses to the Clerk so that summons may be issued and service effected.
