   MINUTE entry before the Honorable M. David Weisman: Magistrate Status/Motion/Ruling on motion hearing held. As to Plaintiff's motion to compel 166 regarding Plaintiff's narrowed request regarding investigation involving Mr. Revis and any policy the investigation was premised on. The Court noted comparator analysis is a substantive issue and not properly resolved during discovery. Defendant asserts Plaintiff overstates deposition testimony and because Mr. Revis is under criminal investigation, the record is confidential and Mr. Roth, the common decision maker at the Secretary of State's Office for both plaintiff and Mr. Revis, has not made any decisions as to Mr. Revis (due in part to the ongoing criminal investigation). The Court inquired whether the criminal investigation as to Mr. Revis is based on similar allegations as those involving Plaintiff's alleged conduct that led to her termination by the Secretary of State's Office. Defense counsel was not at liberty to say, and, in fact, did not know whether the allegations were similar. The Court inquired whether summary documents exist as to the criminal investigation involving Mr. Revis for in camera review. Defendant stated that the matter as a whole is under investigation, so its position is that any related documents are confidential. The Court stated it is not clear what the nature of the criminal investigation is and why some documents could not be produced for in camera review to ascertain whether the document(s) are relevant and discoverable. Defendant further asserted that because there is a pending criminal investigation, and therefore there has not been a decision made regarding Mr. Revis's continued employment, there is nothing to compare related to potential disparate decision making at this time. Plaintiff asserts some preliminary documents, before a final decision on the criminal investigation, may exist and are relevant. Plaintiff still evaluating comparators but believes the number is around 10-15. The Court will issue a written order on Plaintiff's motion. Defendant stated all documents Plaintiff has referenced are generated only after an investigation has been completed, but Plaintiff believes some documentation likely exist as to Mr. Revis' disciplinary action. As to next steps, Plaintiff believes discovery is finished after the issue with Mr. Revis is resolved, and Plaintiff will then confer with Defendant about possible resolution. Status and ruling set for 9/9/26 at 2:00 p.m. Joint status report due by noon on 9/8/26 setting forth whether a settlement conference is requested.
