Order on Motion for Briefing Schedule
MINUTE ORDER: Plaintiffs' 65 Motion for Entry of a Briefing Schedule is DENIED. Upon consideration of the arguments raised by the parties, it is hereby ORDERED that the dispositive motion briefing in this case shall be STAYED until the D.C. Circuit issues an opinion in Vera Institute of Justice v. U.S. Department of Justice, No. 25-5248, or such earlier time as the Court deems appropriate. The Court continues to appreciate the parties' interest in adjudicating the legality of the government's mass grant termination as soon as possible. However, Vera Institute, which this Court previously flagged in its Minute Order of January 12, 2026, bears on several issues presented in this case, including Tucker Act jurisdictional issues. Further, Vera Institute was argued on October 14, 2025, and a decision may arrive soon. See Vera Institute, No. 25-5248, Dkt. (D.C. Cir. Oct. 14, 2025). Therefore, since the balance of considerations between judicial economy and possible hardship to the parties tips in favor of a stay, the Court concludes it is in the interest of justice to stay the case temporarily. See Novenergia II - Energy & Envt (SCA) v. Kingdom of Spain, No. 18-CV-01148 (TSC), 2020 WL 417794, at *2 (D.D.C. Jan. 27, 2020) ("District courts 'have broad discretion in deciding whether to stay proceedings 'pending the resolution of independent legal proceedings.'" (quoting Landis v. N. Am.
