Minute Order Order on Motion for Miscellaneous Relief Order on Motion to Extend/Shorten Time
MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Brenda Weksler on 6/18/2026. Before the Court are three motions from Plaintiff seeking clarification and an extension of time to file his Fourth Amended Complaint. ECF Nos. 267, 268, and 269.The Court clarifies as follows. Plaintiff cannot bring the stated claims against Judge Cris Lee, Erin Tellez, Bianca Cardenas, Leslie Park, Kenneth Frizzell, Lawrence Phillips, Defendants North Las Vegas Police Department, North Las Vegas City Attorneys, and North Las Vegas Community Corrections Center Administrators, nor may he include claims on behalf of others. Plaintiff may bring a properly pleaded § 1983 Monell claim against the City of North Las Vegas, a § 1983 Fourth Amendment claim against Defendant Lieutenant William McDaniel, and a § 1983 joint action claim against Defendants Lawrence Phillips, Jonathon Donager, Nicole Donager, Maggie Hudson, and Lani Naito. See R&R, ECF No. 136; Order Adopting R&R, ECF No. 226. The deadline to file the Fourth Amended Complaint is extended to July 16, 2026. Service instructions will be provided when, and if, any claims in the Fourth Amended Complaint survive screening. The Third Amended Complaint has been stricken, ECF No. 265, and Plaintiff may appeal that decision to Judge Boulware. There is currently no operative complaint on the record. Plaintiff's motions at ECF Nos. 267, 268, and 269 are GRANTED only to the extent set forth in this order.(no image attached) (Copies have been distributed pursuant to the NEF - MAD)
