Order on Motion for Miscellaneous Relief
TEXT ORDER-- Plaintiff, who is proceeding pro se, has filed a "petition for an order authorizing alternative service of process" on all Defendants. (ECF No. 7 ). The petition is DENIED. Plaintiff asserts that he has been barred by a State Court Order from being near Guttenberg Town Hall and that he is thereby unable to personally serve any of Defendants as a result. Assuming that such an Order exists (as Plaintiff submits a document in his papers that is incomplete and does not include a Judge's signature), Plaintiff paid the filing fee and is not proceeding in forma pauperis, so he must bear the expense of retaining a process server to serve papers on Defendants. Furthermore, a pro se Plaintiff is otherwise barred from accomplishing his or her own service of process in his or her own case in general. See Fed. R. Civ. P. 4(c)(2) ("By Whom. Any person who is at least 18 years old and not a party may serve a summons and complaint."). For the same reasons, Plaintiff's request to have the U.S. Marshals Service serve process on his behalf is denied. See Fed. R. Civ. P. 4(c)(3) ("The court must so order [service be made by a United States marshal] if the plaintiff is authorized to proceed in forma pauperis under 28 U.S.C. § 1915"). Plaintiff is DIRECTED to retain a process server in order to effectuate service and proceed with the prosecution of this case accordingly. So Ordered by Magistrate Judge Stacey D. Adams on 8/10/2026.
