SO ORDERED STIPULATION OF PARTIAL DISCONTINUANCE WITH PREJUDICE: IT IS HEREBY STIPULATED AND AGREED, by and between counsel for the parties herein, pursuant to Fed. R. Civ. P. 41(a)(1)(A)(ii), that any all claims arising out of the events alleged in the Complaint as asserted against Defendants The Town of Ossining, Elizabeth Feldman, Jennifer Fields-Tawil, Angelo Manicchio, Gregory G. Meyer, Matthew Weiss, and Susanne Donnelly, in her capacity as Town Clerk of the Town of Ossining only, are hereby voluntarily dismissed with prejudice, and without attorney's fees or costs to any party as against the other. Chavez, Donohue, Kahan, Levin, Quezada, Fritsche, Lopez, White, Donnelly, and D'Attore, Michael Burke, Esq., is present. Counsel for Defendant(s) Feldmman, Fields-Tawill, Meyer, Manicchio, and Weiss, James Randazzo, Esq., is present. Law Clerk Faust Petkovich is present. Plaintiffs' counsel informs the Court that Plaintiff will dismiss the Town of Ossining Defendants. The Court grants Plaintiff(s) leave to amend Complaint. Plaintiffs' Amended Complaint to be submitted by June 6, 2024. Defendants' Motion to Dismiss to be submitted by July 18, 2024; Plaintiffs' opposition due August 26, 2024; Defendants' reply due September 9, 2024. The Court hereby DISMISSES Defendant(s) Feldmann, Fields-Tawill, Manicchio, Meyer, Weiss, and Donnelly (to the extent that she is being sued as the Town Clerk) on consent of the parties. Defendants' counsel James Randazzo, Esq. will submit a Stipulation.
