Order on Motion for Extension of Time
ORDER granting 160 Letter Motion for Extension of Time. The Court is in receipt of Defendant's, City of New York's, request for an extension to file its motion to dismiss filed on August 28, 2026. Plaintiff does not consent to this request. However, in light of the circumstances Defendant outlined, specifically the complexity of the Amended Complaint at ECF No. 126, the Court grants the extension. Defendant shall file its motion to dismiss by October 5, 2026. Plaintiff's Opposition will be due by October 19, 2026. Any Reply will be due by October 26, 2026. The Court is also in receipt of Plaintiff's recently filed Notice of Interlocutory Appeal. Insofar as Plaintiff has not filed a motion for the Court to certify any of its orders for interlocutory appeal, the Parties should continue briefing the motions to dismiss as set by the Court's previous scheduling order at ECF No. 145 and this Order.
