ORDER denying 182 Motion for Leave to Appeal. For the reasons that follow, the Court denies Shymansky's motion for leave to appeal. Under 28 U.S.C. § 1292(b), a district court may certify an otherwise non appealable interlocutory order when "such order involves a controlling question of law as to which there is substantial ground for difference of opinion and [] an immediate appeal from the order may materially advance the ultimate termination of the litigation." All thr ee of these elements must be present. Fairbank Reconstruction Corp. v. Greater Omaha Packing Co., Inc., No. 13 Civ. 907, 2020 WL 7427025, at *4 (S.D.N.Y. Dec. 18, 2020). A district court's power to grant an interlocutory appeal is not construe d liberally. See Klinghoffer v. S.N C. Achille Lauro Ed AltriGestione Motonave Achille Lauro in Amministrazione Straordinaria, 921 F.2d 21, 24-25 (2d Cir. 1990).
