MINUTE ORDER. The Court is in receipt of Defendants' 45 Motion for Extension of Time to File Motion for Summary Judgment Nunc Pro Tunc. Defendants explain that "Defendants' motion and exhibits were timely filed and the docket records these documents as having been filed on the May 9, 2024 deadline. However, due to an incorrectly sourced citation in the [undisputed statement of material facts], [they] had to make a correction at the last minute and file that document separately, resulting in its submission roughly five minutes later," which was then May 10, 2024. Plaintiff does not consent to this requested relief.
In light of the lack of danger of prejudice to Plaintiff, the de minimis length of delay and impact on judicial proceedings, and Defendants' excusable neglect causing the delay, the Court GRANTS the 45 Motion and ORDERS that Defendants' deadline to file their Motion for Summary Judgment is extended, nunc pro tunc, to May 10, 2024; and it is further ORDERED that Defendants' Motion for Summary Judgment is deemed filed as of May 10, 2024.
