MINUTE entry before the Honorable Jeremy C. Daniel: Motion hearing held. Plaintiff did not appear before the Court or contact Chambers regarding any scheduling conflicts. Plaintiff's motion to withdraw 102 and renewed motion for leave to file second amended complaint 111 are denied for reasons stated on the record. The Court orders the plaintiff to show cause why the Court should not dismiss this case for want of prosecution and for violating Fed. R. Civ. P. 11(b)(1). The Court cautioned the plaintiff about frivolous filings. (R. 64.) Yet the plaintiff filed a second motion for leave to file a second amended complaint (R. 111) when the Court denied a similar motion days earlier explaining that it would address the pending motions to dismiss (R. 98). The plaintiff must explain what proper purpose these motions served. The Court also previously cautioned the plaintiff that failure to prosecute his case with diligence could result in dismissal for want of prosecution. (R. 88.) Judge Kocoras had previously dismissed this case for want of prosecution and failure to comply with Court orders. (R. 12.) Yet the plaintiff failed to appear at the motion hearing he noticed for July 28, 2026. Defense counsel appeared and responded to the plaintiff's motions, increasing the defendants' cost of litigation. Rule to show cause hearing scheduled for August 4, 2026, at 9:30 a.m. Failure to appear will result in dismissal for want of prosecution. Mailed notice. (vcf, ) (Entered: 07/28/2026)
