Order on Motion for Leave to Appeal
ORDER GRANTING 5 Motion for Leave to Appeal. The court construes Plaintiff's Motion for Leave to Appeal (Doc. 5) as a motion for extension of time under Fed. R. App. P. 4(a)(5). Plaintiff may file a notice of appeal no later than June 19, 2023. Because Plaintiff was denied leave to proceed in forma pauperis ("IFP") in the district court action, he must comply with Fed. R. App. P. 24 which requires a motion in the district court together with an affidavit that "(A) shows in the detail prescribed by Form 4 of the Appendix of Forms the party's inability to pay or to give security for fees and costs; (B) claims an entitlement to redress; and (C) states the issues that the party intends to present on appeal." Fed. R. App. P. 24(a)(1). Although Plaintiff submitted an application for leave to proceed IFP with his motion, the financial affidavit is insufficient as it fails to include the amounts of his monthly expenses. See Doc. 5-3 at 2. As a result, the court cannot determine whether Plaintiffwith income of $1,100 per month and $400 in a bank accountis unable to pay the filing fee. Thus, the application for leave to proceed IFP (Doc 5-2) is DENIED WITHOUT PREJUDICE. Signed by Judge Christina Reiss on 6/5/2023. (This is a text-only Order.) (ejh)
